Terms of Service

Introduction

Welcome to Birdero! We're excited to have you join our community of bird enthusiasts. These Terms of Service ("Terms") govern your use of the Birdero mobile application (the "Service"), so please read them carefully.

By creating an account or using our Service, you agree to be bound by these Terms.

1. User Accounts

Eligibility: You must be at least 13 years old to create an account and use the Service.

Account Security: You are responsible for safeguarding your account information, including your password. You agree to notify us immediately of any unauthorized use of your account.

Account Information: You agree to provide accurate and complete information when creating your account and to keep this information up-to-date.

2. User-Generated Content

Our Service allows you to post content, including photos, text, sightings, and comments ("User Content"). You retain all rights to your User Content, but you grant Birdero a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute it in connection with the Service.

You are solely responsible for the User Content you post. You agree not to post content that is:
- Illegal, defamatory, harassing, or hateful.
- Infringing on any third party's intellectual property rights, including copyright and trademark.
- Spam or unauthorized advertising.

We reserve the right to remove any User Content that we believe violates these Terms, without prior notice.

3. Community Features & Prohibited Conduct

Birdero is a community platform. You agree to interact with other users respectfully. The following conduct is strictly prohibited:

- Harassing, threatening, or intimidating other users.
- Using the Service for any illegal or unauthorized purpose.
- Impersonating another person or entity.
- Attempting to gain unauthorized access to our systems or another user's account.

We reserve the right to suspend or terminate your account if you engage in prohibited conduct.

4. Data Collection and Use

By using Birdero, you agree that we can collect and use information as described below. Our goal is to provide and improve the Service, and we are committed to being transparent about how we use your data.

- For Account Functionality: We collect data that is essential for the Service to function. This includes your email address for account creation, your profile information (like username and name), and the content you generate (such as sightings, posts, and comments). This data is necessary to provide you with the core features of the app, like your profile, life lists, and community interactions.

- For Analytical Purposes: To understand how our users engage with the Service, we collect anonymized data about app usage. This includes information like which features are most popular, how often the app is used, and performance data like crash reports. This data is aggregated and does not personally identify you. We use it solely to improve the app's functionality, fix bugs, and build a better experience for our community.

5. Data Sharing for Science

One of our core missions is to contribute to scientific research. If you opt-in, your public sighting data may be shared with research partners like the Global Biodiversity Information Facility (GBIF).

- Your Control: You can enable or disable data sharing at any time in the "Science" section of the app's settings.

- Data Privacy: To protect sensitive species and private locations, we only share generalized location data, not exact coordinates. Only public sightings are shared.

6. Intellectual Property

The Birdero application, its design, logo, and features are the exclusive property of Birdero and its licensors. User Content is the property of the user who posted it.

7. Termination

You can delete your account at any time through the app's settings. This action is irreversible and will permanently delete your profile, posts, comments, and all other associated data from our servers.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms.

8. Terms and conditions of sale

Paid Products

Some of the Products (such as a "Pro Member" subscription) provided on Birdero, as part of the Service, are provided on the basis of payment.

The fees, duration and conditions applicable to the purchase of such Products are described below and in the dedicated sections of Birdero.

Product description

Prices, descriptions, or availability of Products (Subscriptions) are outlined in the respective sections of Birdero and are subject to change without notice.

While the features and Products on Birdero are presented with the greatest accuracy technically possible, representation on Birdero through any means (including, as the case may be, graphic material or images) is for reference only and implies no warranty as to the characteristics of the purchased Product.

The characteristics of the chosen Product (e.g., the features included in a "Pro Member" subscription) will be outlined during the purchasing process.

Purchasing process

Any steps taken from choosing a Product to order submission form part of the purchasing process.The purchasing process includes these steps:

- Users must choose the desired Product (e.g., monthly or annual subscription) and verify their purchase selection.

- After having reviewed the information displayed in the purchase selection, Users may place the order by submitting it.

Order submission

When the User submits an order, the following applies:

- The submission of an order determines contract conclusion and therefore creates for the User the obligation to pay the price, taxes, and possible further fees and expenses, as specified on the order page.

- In case the purchased Product requires an action from the User, such as the provision of personal information or data, the order submission creates an obligation for the User to cooperate accordingly.

- Upon submission of the order, Users will receive a receipt confirming that the order has been received (typically from the app store provider, e.g., Apple or Google).

All notifications related to the described purchasing process shall be sent to the email address associated with the User's app store account.

Prices

Users are informed during the purchasing process and before order submission, about any fees, taxes, and costs that they will be charged. Prices on Birdero are displayed either exclusive or inclusive of any applicable fees, taxes, and costs, depending on the section the User is browsing.

Offers and discounts

The Owner may offer discounts or provide special offers for the purchase of Products. Any such offer or discount shall always be subject to the eligibility criteria and the terms and conditions set out in the corresponding section of Birdero.

Offers and discounts are always granted at the Owner’s sole discretion. Repeated or recurring offers or discounts create no claim/title or right that Users may enforce in the future.

Depending on the case, discounts or offers shall be valid for a limited time only. If an offer or discount is limited by time, the time indications refer to the time zone of the Owner, as indicated in the Owner’s location details in this document, unless otherwise specified.

Coupons

Offers or discounts can be based on Coupons. If breach of the conditions applicable to Coupons occurs, the Owner can legitimately refuse to fulfil its contractual obligations and expressly reserves the right to take appropriate legal action to protect its rights and interests.

Unless otherwise stated, these rules apply to the use of Coupons:

- Each Coupon is only valid when used in the manner and within the timeframe specified.
- A Coupon may only be applied, in its entirety, at the actual time of purchase.
- Unless otherwise stated, single-use Coupons may only be used once per purchase.
- A Coupon cannot be applied cumulatively.
- The Coupon must be redeemed exclusively within the time specified in the offer. After this period, the Coupon will automatically expire.
- The User is not entitled to any credit/refund/compensation if there is a difference between the value of the Coupon and the redeemed value.

Methods of payment

Information related to accepted payment methods is handled by the third-party app stores through which the purchase is made (e.g., Apple App Store, Google Play Store).

Birdero does not directly collect or process any payment information – such as credit card details. All payments are independently processed through third-party services (the app stores). Birdero only receives a notification from the third-party provider once the payment has been successfully completed.

If a payment through the available methods fails or is refused by the payment service provider, the Owner shall be under no obligation to fulfil the purchase order or provide the service.

Purchase and Subscriptions via App Store

Birdero or specific Products (Subscriptions) available for sale on Birdero must be purchased via a third-party app store (such as the "Apple App Store" or "Google Play"). To access such purchases, Users must follow the instructions provided on the relevant online store.

When doing so, Users acknowledge and accept that:

- Any payment due shall be charged to their account with that third-party provider (e.g., their Apple ID or Google Play account).
- Subscriptions are automatically renewed for the same duration unless the User cancels at least 24 hours before the current period expires.
- Any and all fees or payments due for renewal will be charged by the third-party provider within 24 hours before the end of the current period.
- Subscriptions must be managed or cancelled directly by the User through their personal account settings on the respective third-party app store (e.g., in their device's "Settings" for Apple ID, or in the "Subscriptions" section of the Google Play Store).

Purchases done via third-party online stores are also subject to such third-parties’ terms and conditions. In case of any inconsistency or conflict, those third-party terms shall prevail upon these Terms. Users purchasing through such third-party online stores must therefore read such terms and conditions of sale carefully and accept them.

Retention of usage rights

Users do not acquire any rights to use the purchased Product (e.g., "Pro Member" features) until the total purchase price is successfully received by the Owner (via the third-party app store).

Contract duration

Trial period Users may have the option to test Birdero or selected Products during a limited and non-renewable trial period, at no cost. Some "Pro Member" features or functions of Birdero may not be available to Users during the trial period.

Further conditions applicable to the trial period, including its duration, will be specified on Birdero.

The trial period may automatically convert into the equivalent paid Product (Subscription), unless the User cancels the trial through their app store account settings before the trial period expires.

Subscriptions allow Users to access the "Pro Member" features continuously or regularly over time. Paid subscriptions begin on the day the payment is received by the Owner via the third-party app store.

In order to maintain subscriptions and access to Pro features, Users must ensure the required recurring fee is paid in a timely manner. Failure to do so may cause service interruptions and a reversion to a non-pro member status.

Termination

Recurring subscriptions may be terminated at any time by the User.

As all subscriptions are handled via third-party app stores (see section "Purchase and Subscriptions via App Store"), the User must terminate their subscription by using the corresponding controls inside their Apple App Store or Google Play Store account settings.

Termination will take effect at the end of the current paid billing period. The User will retain access to the "Pro Member" features until that date.

User rights

Right of withdrawal, Unless exceptions apply, the User may be eligible to withdraw from the contract within the period specified below (generally 14 days), for any reason and without justification. Users can learn more about the withdrawal conditions within this section.

Who the right of withdrawal applies to, Unless any applicable exception is mentioned below, Users who are European Consumers are granted a statutory cancellation right under EU rules, to withdraw from contracts entered into online (distance contracts) within the specified period applicable to their case, for any reason and without justification.

Users that do not fit this qualification cannot benefit from the rights described in this section.

Exercising the right of withdrawal, To exercise their right of withdrawal, Users must send to the Owner an unequivocal statement of their intention to withdraw from the contract. To this end, Users may use the model withdrawal form available from within the “definitions” section of this document. Users are, however, free to express their intention to withdraw from the contract by making an unequivocal statement in any other suitable way.

In order to meet the deadline within which they can exercise such right, Users must send the withdrawal notice before the withdrawal period expires.

When does the withdrawal period expire? Regarding the purchase of a digital service (like a subscription), the withdrawal period expires 14 days after the day that the contract is entered into, unless the User has waived the withdrawal right.

Effects of withdrawal, Users who correctly withdraw from a contract will be reimbursed by the Owner for all payments made to the Owner.

Such reimbursement shall be made without undue delay and, in any event, no later than 14 days from the day on which the Owner is informed of the User’s decision to withdraw from the contract. Unless otherwise agreed with the User, reimbursements will be made using the same means of payment as used to process the initial transaction. In any event, the User shall not incur any costs or fees as a result of such reimbursement.

Where a User exercises the right of withdrawal after having requested that the service be performed before the withdrawal period expires, the User shall pay to the Owner an amount which is in proportion to the part of service provided. Such payment shall be calculated based on the fee contractually agreed upon, and be proportional to the part of service provided until the time the User withdraws, compared with the full coverage of the contract.

Exceptions to the Right of WithdrawalThe right of withdrawal is lost once the User has started to use the service (e.g., by accessing the "Pro Member" features) after having (a) expressly consented to the performance starting before the 14-day withdrawal period expires and (b) acknowledged that they thereby lose their right of withdrawal.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without any warranties. Birdero is not liable for any damages that may occur from your use of the Service, to the fullest extent permitted by law.

10. Governing Law

These Terms shall be governed by the laws of Sweden, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms from time to time. If we make changes, we will provide notice through the Service or by other means. By continuing to use the Service after those changes become effective, you agree to be bound by the revised Terms.
